Terms of Service

Last updated: October 29, 2026

0. Who This Agreement Is With

These Terms of Service ("Terms") are a binding agreement between you, the professional or business that signs up ("you" or the "Provider"), and BIZYROCKET LLC, an Arkansas limited liability company ("BizyRocket"), which operates Beauty'd ("we", "us" or "Beauty'd"). You accept these Terms by ticking the agreement box when you sign up or start a free trial. If you sign up for a business, you confirm that you have the authority to bind that business. If you do not agree, do not use the Service.

1. Service Description

Beauty'd ("the Service") is a scheduling, appointment management, and communication platform for service providers. The Service includes appointment scheduling, SMS reminders, payment processing integration, and related business tools.

2. Account Terms

You must provide accurate and complete registration information. You are responsible for maintaining the security of your account credentials. You must be at least 18 years of age to use this Service.

3. Payment Terms

Your subscription is billed monthly: the $10/week plan is charged as a single monthly payment of $43.33. Every plan includes 500 text messages and 150 AI Receptionist minutes a month. All fees are non-refundable except as required by law. You may cancel your subscription at any time; access continues through the end of the billing period.

Charges you did not make: if you see a Beauty'd charge you did not authorize, tell us at beautied.com/contact within 60 days. We reply within 2 business days and refund any charge we cannot show you authorized. Our subscription payments are processed by Dodo Payments, which you can also contact at dodopayments.com.

4. Free Trial

New accounts receive a 7-day free trial with full feature access for up to 25 clients, including 50 text message reminders and 15 AI Receptionist minutes. The free trial is offered once per person, phone number and email address. If we find one was used before, the new account starts without a trial. To add more than 25 clients, choose a plan. No credit card is required to start. During the trial, the AI Receptionist answers your calls with no card, up to the included minutes. You need a card only to let the AI Receptionist book appointments for you.

If you use up the trial texts and have not chosen a plan, your text reminders stop until you choose one.

To keep using the Service after the trial, choose a plan and add a card. If you choose a plan during the trial, it is first charged on the day the trial ends; if you choose it after, it is charged that day. It then renews every month until you cancel. Every plan includes 500 text messages and 150 AI Receptionist minutes a month. If a plan payment fails and we are still trying it again, you keep that calendar month’s included 500 text messages and 150 AI Receptionist minutes, but you cannot use more than that until the payment goes through. If the payment does not go through and your plan ends, the 7 days described below apply.

If you do not choose a plan, no plan is charged. When the trial ends, you keep access to all of your information and the appointments already booked, but you cannot take new bookings or use the AI Receptionist.

When your trial ends, or your trial AI Receptionist minutes run out, and you have not chosen a plan, or when a paid plan ends, the AI Receptionist stops answering calls your phone forwards to us. Instead, we tell each caller to reach you another way and send you a text with their name and number. This lasts 7 days, counted from when that first happens or from our first notice text about it, whichever is later. Texts about single missed calls do not start the 7 days. After that, calls your phone forwards to us are not connected: the caller hears no message, and you get no text. To stop this, turn off call forwarding on your phone.

5. Limitation of Liability

5.1 Beauty'd is a scheduling and communication tool, not a guarantee of business outcomes. The Service, including the AI Receptionist, is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Service will be uninterrupted, error-free or always available, or that any message, call or booking will be delivered or recorded correctly.

5.2 To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost bookings, lost data or harm to your reputation, however caused, even if we were told they were possible.

5.3 To the fullest extent the law allows, our total liability for all claims relating to the Service or these Terms is limited to the greater of (a) the fees you paid us in the 12 months before the event that gave rise to the claim, or (b) one hundred U.S. dollars ($100).

5.4 Some states do not allow some of these limits. Where a limit is not allowed, it applies to the fullest extent that state's law permits, and the rest of this section still applies.

6. Indemnification

6.1 You will defend, indemnify and hold harmless BizyRocket and Beauty'd, and their owners, officers, employees, contractors and agents, from and against any claim, demand, loss, damage, fine, cost or expense (including reasonable attorneys' fees) arising out of or related to:

(a) your use of the Service;

(b) your services, your business and your dealings with your clients, including appointments, payments, refunds, cancellations, no-shows and complaints;

(c) calls the AI Receptionist answers for you and requests it records for you, including any mistake it makes;

(d) messages sent at your direction or to contacts you add, and any consent you were required to obtain from your clients;

(e) content or information you provide, including client information;

(f) your breach of these Terms or of any law; and

(g) any dispute between you and another Provider, including inside an inventory group or a shared booking arrangement.

6.2 This section does not cover a claim to the extent it was caused by our own gross negligence or willful misconduct.

6.3 We will tell you about a claim we ask you to cover. We may take over the defense ourselves, and you will cooperate with us. You may not settle a claim that admits fault for us or binds us to do anything without our written consent.

7. Acceptable Use

You may not use the Service for any unlawful purpose, to send spam or unsolicited communications, to harass or abuse clients or other users, to engage in fraudulent activity, or to bring over information from another service that isn't yours. Violation may result in immediate account termination.

8. Data and Privacy

We collect and process data as described in our Privacy Policy. Client data entered by Providers (names, phone numbers, notes) is the Provider's responsibility. Beauty'd processes this data on the Provider's behalf.

9. Termination

Either party may terminate this agreement at any time. Upon termination, Provider's access to the Service will cease at the end of the current billing period. Provider may export their data before account closure.

10. Referral Earnings Cap

Referral earnings are capped at $2,000 per month. This cap may change at any time.

11. Changes to Terms

We may update these Terms. We will tell you about material changes in the app, and by email or text when we have a working address, at least 30 days before they take effect, unless a change is required by law sooner. If you keep using the Service after a change takes effect, you accept it. We may also ask you to agree again by ticking a box. A change to §14 (Disputes) does not apply to a dispute that either of us had already raised in writing before the change took effect.

12. Moving Your Data From Another Service

When you ask us to, we sign in to your account on another booking service you use, such as Booksy, for you, and copy your business information into the Service: your appointments, your clients and their contact details, your services, prices and hours, your photos, and the reviews your clients left about you. This is information you or your staff put there: you entered your clients and appointments, and took and uploaded your photos. We use your sign-in details only to copy it, and your clients' information only to run your business on the Service. When you say yes, you confirm that you, your staff, or your clients put this information into that account. If someone shows us that something we copied belongs to them and not to you, we will take it off the Service.

13. Text Messaging Terms

Beauty'd Appointment Texts: when you book with a salon on Beauty'd and tick the text box, or ask a salon's phone line for a booking link, Beauty'd texts you about your appointments: confirmations, reminders and changes, and a booking link when you ask for one. Message frequency varies. Message and data rates may apply. Reply HELP for help or STOP to cancel; after STOP you get one text confirming it and no more. For support, contact us at beautied.com/contact. Carriers are not liable for delayed or undelivered messages. See our Privacy Policy for how we handle your information.

14. Disputes and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS HOW DISPUTES ARE RESOLVED, INCLUDING A WAIVER OF JURY TRIALS AND CLASS ACTIONS.

14.1 Fix it first, then talk for 30 days. Most problems can be worked out, and both of us agree to try. We care about the people who use Beauty'd, and our support and technical team is here to help you when something goes wrong.

(a) Fix it first. Before sending a notice under (b), the party with the problem gives the other a chance to fix it. You report the problem to our support team through Beauty'd's contact page or the help button in the app. We will answer within 2 business days and work in good faith to fix it. If we have a problem with your account (for example, an unpaid charge), we tell you through the app, email or text and give you the same chance to fix it. Either of us may send a notice under (b) once 10 business days have passed since the problem was reported without it being fixed.

(b) Notice. Before starting arbitration or any court case, the party with the complaint must send the other a written notice describing it and the relief wanted. You send yours through Beauty'd's contact page while signed in; we send ours to the email or phone number on your account and in the app.

(c) Talking period. For at least 30 days after the notice is received, both of us will keep talking in good faith to resolve it: each of us answers the other's messages within 3 business days and takes part in at least one phone or video call if the other asks for one.

(d) Refusing to talk. A party "refuses to talk" if, after a written reminder, it still has not answered a message within 5 business days, or if it declines a requested call or misses an agreed call without rescheduling it within 3 business days.

• If the party with the complaint refuses to talk, the 30 days start over on the day it starts talking again.

• If the other party refuses to talk, the talking period ends at once, and the party with the complaint may go ahead under (f).

• This applies to both of us in the same way: if we refuse to talk about your complaint, you may go ahead without waiting.

(e) Cooldown. If a conversation becomes heated, either of us may call a cooldown by writing "cooldown" (in the app, by email or by text). For the next 24 hours, neither of us sends the other any message about the Dispute. Within 3 business days after the 24 hours end, we resume talking. Each of us may call up to two cooldowns per Dispute. A cooldown does not stop the Service, billing, or your right to cancel, and it does not stop messages needed to run your account.

(f) When it ends. The talking period ends 30 days after the notice is received (or after the last restart under (d)), extended by the days spent in any cooldown, but never later than 60 days after that date. Only then may either of us start arbitration (or a small-claims case under §14.6(a)). Any deadline in §14.7 pauses during steps (a) to (f), but for no more than 90 days in total for any one Dispute.

(g) A case filed too early goes back. If either of us files an arbitration or a court case about a Dispute before steps (a) to (f) are finished, or files in court a Dispute that §14.2 sends to arbitration, the other may ask that the case be paused or dismissed so that this §14.1 process, and then arbitration, happen first. The party that filed early pays the other party's reasonable attorneys' fees and costs of getting the case paused or dismissed. This does not apply to a request for an urgent court order under §14.6(b).

14.2 Binding arbitration. If the dispute is not resolved under §14.1, any dispute, claim or controversy between you and us arising out of or relating to these Terms, the Service, or your account (a "Dispute") will be resolved by final and binding arbitration, except as §14.6 allows. This includes Disputes about the scope, validity or enforceability of this section, which the arbitrator decides. The exceptions are questions about §14.5 (no class actions) and about the hardship rule in §14.4, which a court in Benton County, Arkansas may decide.

14.3 How arbitration works. The American Arbitration Association ("AAA") administers it under its Commercial Arbitration Rules in effect when the Dispute is filed. A single, neutral arbitrator decides it. The arbitration takes place in Centerton, Arkansas, or the nearest AAA location in Benton County, Arkansas. If the total claimed is $25,000 or less, either party may choose to hold it on documents alone or by phone or video. The arbitrator applies Arkansas law and these Terms and may award the same individual relief a court could. The award is final, and judgment on it may be entered in any court with jurisdiction. The Federal Arbitration Act governs this section.

14.4 Who pays.

(a) The party that starts an arbitration pays the AAA filing fee, the AAA administrative fees, and the arbitrator's compensation. So when you start an arbitration, you pay these costs, and when we start one, we do.

(b) Hardship. If you start an arbitration and show the arbitrator, at the outset, that these costs would be prohibitively expensive for you compared with the cost of bringing the same claim in court, we will pay the part of them that the arbitrator decides is needed so the costs are not prohibitive for you. You pay the rest. In deciding, the arbitrator considers your business's size, number of locations and revenue, and the amount you are claiming. A business that can afford the costs pays them in full.

(c) Each party pays its own attorneys' fees and costs, unless the arbitrator finds that a claim or defense was frivolous or brought in bad faith, or the law requires otherwise. In those cases the arbitrator may order the other side's fees paid.

14.5 No class actions, no jury. You and we may each bring a Dispute only for ourselves, and not as a plaintiff or class member in any class, collective, consolidated or representative proceeding. The arbitrator may not combine more than one person's claims and may award relief only to the individual party asking for it. YOU AND WE EACH GIVE UP THE RIGHT TO A JURY TRIAL.

14.6 What stays out of arbitration.

(a) Either party may bring an individual claim in small claims court in Benton County, Arkansas, if it qualifies there and stays there.

(b) Either party may ask a court in Benton County, Arkansas for an order to stop misuse of the Service, of its software, or of either party's trademarks or confidential information, while the rest of the Dispute goes to arbitration.

14.7 Time limit. To the fullest extent the law allows, a Dispute must be raised in a written notice under §14.1 within one (1) year after the facts giving rise to it occurred. Otherwise it is permanently barred.

14.8 If part of this section fails.

If a court finds §14.5 (no class actions) unenforceable for a particular claim, that claim alone goes to a state or federal court in Benton County, Arkansas, and waits until any arbitration of the remaining claims ends. Everything else in §14 still applies.

If the cost rules in §14.4 are found unenforceable, the arbitrator divides those costs only as far as needed to make them enforceable, and the rest of §14 still applies.

14.9 Clients. This section governs Disputes between you and us. It does not govern a dispute between you and your own clients, which is yours to resolve.

15. Governing Law and Courts

These Terms are governed by the laws of the State of Arkansas, without regard to its conflict-of-laws rules, and by the Federal Arbitration Act for §14. Any matter that may go to court under these Terms goes only to the state or federal courts located in Benton County, Arkansas. You and we consent to their jurisdiction.

16. General

16.1 Severability. If any part of these Terms is found unenforceable or invalid in any state or for any reason, it is enforced to the fullest extent permitted, or narrowed as little as possible, and it is unenforceable only where and as far as required. Every other part stays in full force.

16.2 Entire agreement. These Terms, the Privacy Policy, and any feature terms you accept in the app (such as the AI Receptionist Terms) are the whole agreement between you and us about the Service. If feature terms conflict with these Terms, the feature terms control for that feature.

16.3 No waiver. If we do not enforce a right right away, we have not given it up.

16.4 Assignment. You may not transfer these Terms without our written consent. We may transfer them in connection with a merger, acquisition or sale of assets, or to an affiliate.

16.5 Events beyond control. Neither of us is liable for a delay or failure caused by events beyond reasonable control, such as outages of a carrier, cloud or payment provider, natural disasters, or acts of government.

16.6 Survival. Sections 5, 6, 14, 15 and 16, and any amounts you owe, survive the end of these Terms or of your account.

16.7 Language. These Terms may be shown in other languages. If a translation differs from the English version, the English version controls.

16.8 Notices. We may give you notices in the app, by email or by text to the contact details on your account. You give us notices through the contact page while signed in.
